A&W Scores Trial Victory
Congratulations to Tom and Jerry on their trial victory in Franklin County. A workers’ compensation claimant claimed that she injured her right shoulder when she lifted a two ounce plastic bottle. After Tom elicited cross-examination testimony from the Claimant that her own doctor was "a liar" the jury returned a 7-1 verdict in favor of our client. The verdict denies a claim that would have cost the company tens of thousands of dollars in additional workers’ compensation premium.
An important turning point in the case was the instructions given to the jury. Jerry's effective research and brief writing convinced the Judge to include an instruction on idiopathic injuries. In speaking with the jury after the verdict, they revealed that they felt compelled to follow the law even though they were somewhat sympathetic to the claimant. The combination of a persuasive trial presentation and effective "behind the scenes" research and writing delivered a victory.
